Terms of Service

1. Acceptance of Terms

By accessing or using SynthIdol ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

You must be at least 18 years old to use this Service. By using SynthIdol, you represent and warrant that you are at least 18 years of age.

2. Description of Service

SynthIdol is an AI-powered image generation platform that allows users to create digital portraits and artwork. The Service includes:

  • AI image generation using text prompts
  • Custom model training (Muse feature)
  • Image library storage
  • Image editing and enhancement tools

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

3. Account Registration

To use SynthIdol, you must:

  • Create an account with a valid email address
  • Verify your email within 48 hours (unverified accounts are automatically deleted)
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Credits and Payments

4.1 Credit System

SynthIdol operates on a credit-based system. Credits are required to generate images and use certain features. Credit costs vary by feature and quality settings.

4.2 Purchasing Credits

  • Credits can be purchased as one-time/refillable packages or through subscriptions
  • All prices are displayed in USD unless otherwise stated
  • Subscription credits accumulate month-to-month, capped at 3,000 credits
  • One-time purchase credits have no accumulation cap

4.3 Refund Policy

  • Credits are non-refundable once purchased
  • Unused credits do not expire while your account is active
  • Upon account termination, unused credits are forfeited
  • Refunds may be considered on a case-by-case basis for technical issues

4.4 Subscriptions

  • Subscriptions automatically renew unless cancelled
  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • No partial refunds for unused subscription periods

5. Acceptable Use Policy

You agree NOT to use SynthIdol to create, upload, or distribute content that:

5.1 Illegal Content

  • Violates any applicable law or regulation
  • Depicts child sexual abuse material (CSAM) or minors in sexual situations
  • Promotes terrorism, violence, or illegal activities
  • Constitutes fraud, phishing, or financial scams

5.2 Harmful Content

  • Non-consensual intimate imagery ("revenge porn")
  • Realistic depictions of real people without their consent (deepfakes)
  • Content intended to harass, bully, or threaten others
  • Hate speech targeting race, ethnicity, religion, gender, or sexual orientation
  • Content promoting self-harm or suicide

5.3 Deceptive Content

  • Impersonation of real individuals for fraudulent purposes
  • Fake news or disinformation intended to deceive
  • Misleading political content or election interference
  • Fraudulent endorsements or testimonials

5.4 Technical Violations

  • Attempting to reverse engineer or extract our AI models
  • Automated scraping or bulk downloading
  • Circumventing rate limits or security measures
  • Sharing account credentials or reselling access

Violation of these policies will result in immediate account termination without refund. We may report illegal content to law enforcement authorities.

6. Intellectual Property

6.1 Your Content

You retain ownership of:

  • Original prompts and creative inputs you provide
  • Reference images you upload (you must own rights to these)

6.2 Generated Images

For images generated using SynthIdol:

  • You are granted a worldwide, royalty-free license to use generated images for personal and commercial purposes
  • You may sell, license, or distribute generated images
  • You are responsible for ensuring your use complies with applicable laws
  • We retain the right to use generated images to improve our service (in anonymized form)

6.3 Our Content

SynthIdol retains all rights to:

  • The Service's software, design, and branding
  • Our AI models and underlying technology
  • Documentation and marketing materials

7. Content Moderation

We employ automated and manual content moderation to enforce our Acceptable Use Policy. We reserve the right to:

  • Review content generated on our platform
  • Remove content that violates our policies
  • Suspend or terminate accounts without notice for violations
  • Report illegal content to appropriate authorities

Content moderation decisions are final. Appeals may be submitted to support@synthidol.com.

8. Disclaimers

8.1 Service Provided "As Is"

SynthIdol is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability or fitness for a particular purpose
  • Accuracy or reliability of generated content
  • Uninterrupted or error-free operation
  • Security of data transmission or storage

8.2 AI Limitations

AI-generated content may:

  • Contain errors, artifacts, or unexpected results
  • Occasionally produce content that doesn't match your intent
  • Vary in quality between generations

We do not guarantee specific results from any generation.

9. Limitation of Liability

To the maximum extent permitted by law, SynthIdol and its operators shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or goodwill
  • Service interruptions or data breaches
  • Third-party claims arising from your use of generated content

Our total liability shall not exceed the amount you paid to SynthIdol in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless SynthIdol, its operators, and affiliates from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Content you generate or upload
  • Your violation of these Terms
  • Your violation of any third-party rights

11. Account Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Violation of these Terms or Acceptable Use Policy
  • Fraudulent or illegal activity
  • Non-payment or payment disputes
  • Extended inactivity (accounts inactive for 2+ years)

You may delete your account at any time. Upon termination:

  • Your access to the Service will be revoked
  • Your generated images will be deleted within 30 days
  • Unused credits will be forfeited

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use of SynthIdol after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SynthIdol operates, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or your use of SynthIdol shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
